[原创]【讨论】劳动合同到期不续签的情况下,单位是否必须提前一个月通知?

<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 有这样一个问题,一直找不到确切的答案(也就是找不到相关的法律依据的支持),拿来同朋友们一起探讨一下:</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 劳动合同到期,单位不想再续签的情况下,提前1一个月通知员工不再续签劳动合同是否是单位必须应尽的义务呢?在《劳动合同法》中也没有找到相应的规定,不知朋友们对此都真么看待和处理?在单位方没有提前通知的情况下是否需要支付一个月的代通知金呢?</p>

《劳动合同法》中并没有规定说劳动合同到期必须提前一个月通知,只是在实际操作中,避免可能因为员工不愿续签,而公司没有先行告知,而造成公司被动到期不续签需要补偿的情况。也就是说,公司无论续不续签,最好先摸清楚员工的意愿,留下书面证明材料,减少不必要的损失。

<p>原劳动部发布的《关于加强劳动合同管理完善劳动合同制度的通知》第5条要求,用人单位在劳动合同期满前应当提前一个月向职工提出终止或续订劳动合同的书面意向,并及时办理有关手续。除了这个通知外,再无国家级法律法规对这个问题有明确的规定。但地方上的法规,有的对这个还是有明确规定的。比如北京出台《北京市劳动合同规定》第40条规定,劳动合同期限届满前,用人单位应当提前30日将终止或者续订劳动合同意向以书面形式通知劳动者,经协商办理终止或者续订劳动合同手续。同时,第47条规定,用人单位违反本规定第四十条规定,终止劳动合同未提前30日通知劳动者的,以劳动者上月日平均工资为标准,每延迟1日支付劳动者1日工资的赔偿金。</p>

<p>实际操作中,为了给予员工一个适应期,同时也是缓和双方矛盾,建议提前一个月通知。</p>
