mso-hansi-font-family: ''; mso-ascii-font-family: ''">草案第十二条规定:</SPAN><SPAN lang=EN-US><SPAN style="FONT-FAMILY: ; mso-spacerun: yes">&nbsp; </SPAN></SPAN><SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: ''; mso-ascii-font-family: ''">“以劳动力派遣形式用工的用人单位,应当在指定银行账户中以每一名被派遣的劳动者不少于五千元为标准存入备用金。”第四十条规定:“劳动者被派遣到接受单位工作满一年,接受单位继续使用该劳动者的,劳动力派遣单位与劳动者订立的劳动合同终止,</SPAN><SPAN lang=EN-US><SPAN style="FONT-FAMILY: ; mso-spacerun: yes">&nbsp; </SPAN></SPAN><SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: ''; mso-ascii-font-family: ''">由接受单位与劳动者订立劳动合同。”有些常委委员认为,</SPAN><SPAN lang=EN-US><SPAN style="FONT-FAMILY: ; mso-spacerun: yes">&nbsp; </SPAN></SPAN><SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: ''; mso-ascii-font-family: ''">目前我国劳务派遣发展迅速,但较为混乱,侵害劳动者权益的情形屡有发生,亟需加以规范,建议对劳务派遣设专章或专节作出规定。有的常委委员提出,备用金抬高了劳务派遣单位的门槛,但与保护劳动者权益并无直接关系,而且会产生将备用金转嫁到劳动者或者用工单位等问题,建议删去草案关于备用金的规定。有的常委委员提出,草案关于劳务派遣工在接受单位工作满一年,接受单位继续使用的,就应与其签订劳动合同的规定过于严格,实际上难以做到,建议作出修改。法律委员会经同国务院法制办、劳动保障部、全国总工会研究,并征求部分劳务派遣单位和用工单位对修改方案的意见,建议从法律上明确劳务派遣单位、用工单位和被派遣劳动者三方权利义务出发,对劳务派遣设专节作如下规定:</SPAN><SPAN lang=EN-US style="FONT-FAMILY: ">(1)</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: ''; mso-ascii-font-family: ''">劳务派遣单位是本法所称用人单位,应当履行用人单位对劳动者的全部义务。劳务派遣单位应当与被派遣劳动者订立二年以上的固定期限劳动合同。</SPAN><SPAN lang=EN-US style="FONT-FAMILY: ">(</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: ''">告知被派遣劳动者的工作要求和劳动报酬;</SPAN><SPAN lang=EN-US style="FONT-FAMILY: "><SPAN style="mso-spacerun: yes">&nbsp; </SPAN>(</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: ''; mso-ascii-font-family: ''">三</SPAN><SPAN lang=EN-US style="FONT-FAMILY: ">)</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: ''; mso-ascii-font-family: ''">支付加班费、绩效奖金,提供与工作岗位相关的福利待遇;</SPAN><SPAN lang=EN-US style="FONT-FAMILY: "><SPAN style="mso-spacerun: yes">&nbsp;
